PIP, MedPay, and third-party claims in Texas and Florida

Most of the confusion after a collision is not clinical — it is about who pays for the visit. Here is the plain-language version. This is general information, not legal advice.

PIP, MedPay, and third-party claims in Texas and Florida

PIP (Personal Injury Protection)

PIP pays your medical bills and a portion of lost wages regardless of who caused the crash. In Florida it is required on most auto policies and generally must be used promptly after the crash. In Texas it is offered with every policy and must be rejected in writing to be absent.

MedPay

MedPay is optional coverage that pays medical expenses without regard to fault and without the wage component. It commonly sits alongside health insurance and can cover deductibles and copays.

Third-party liability claims

This is the claim against the at-fault driver's insurer. It typically settles once treatment is complete or maximum medical improvement is reached — which is why it rarely pays bills as they arrive.

Health insurance and letters of protection

Health insurance can be used and may later assert a lien on settlement funds. Where a claim is pending, some providers accept a letter of protection from an attorney, deferring payment until resolution.

Practical order of operations

In most cases the sequence looks like this.

  • Use PIP or MedPay first for immediate care
  • Use health insurance once those limits are exhausted
  • Pursue the third-party claim for what remains
  • Keep every bill, receipt, and mileage log
Key takeaway

PIP and MedPay pay now regardless of fault; the liability claim pays later. Know which coverages you carry before the first appointment.
